TUSKER LITE RWENZORI MARATHON TERMS & CONDITIONS AND INDEMNITY AGREEMENT - 2024 EVENT

By entering the Tusker Lite Rwenzori Marathon, Half Marathon, 10 km and 5 km Fun Runs (collectively referred to as "the Event") organized by Equator Hikes Limited, I acknowledge and agree to the following terms and conditions:

1. I acknowledge that the Event involves inherent risks of serious injury, illness, death, and/or damage to participants, sports equipment, and other property. I understand and accept the risks inherent in the Event, including but not limited to risks arising from my skill and ability as a participant, my nutrition and fluid intake, my fitness and health, the terrain, weather conditions, vehicular and other road traffic, and the actions of other participants, event organizers, and sponsors.
2. I agree to withdraw from participation in the Event if advised or instructed by the event organizer to do so or if I sense or observe any unusual hazard or unsafe condition that may affect my safety. I will not participate if I feel unable or unfit to safely continue with the Event.
3. I understand that I may be photographed and/or filmed before, during, and after the Event, and I consent to the use of my photographic, film, or video image or likeness and my name by the event organizer, sponsors, and their representatives for any legitimate purpose in connection with the Event or future events organized by the event organizer.
4. I acknowledge that the event organizer may contact me from time to time for event-related information, advertising certain products and/or services, and advertising other running events organized by the event organizer, and I consent to such communication.
5. I hereby indemnify and hold harmless the parties to the fullest extent possible in law against any claims arising from my participation in the Event, including but not limited to any loss, injury, harm, illness, death, or damage of any nature and howsoever caused, arising directly or indirectly from any act or omission, including negligent acts or omissions by the parties.
6. I confirm that I understand the importance and meaning of this liability disclaimer, waiver of claims, and indemnity, and I acknowledge that I have been free to seek independent legal and/or other advice regarding these provisions. I have either taken such independent advice or dispensed with the necessity of doing so.
7. I understand that no refunds or substitutions/changes will be issued for any confirmed and paid entries for the Tusker Lite Rwenzori Marathon.
8. I acknowledge that the Event may be cancelled or delayed due to forces beyond the event organizer's control, and I agree to waive any claims arising from such circumstances.
9. I confirm that I have read and understood these terms and conditions and agree to be bound by them upon entry into the Tusker Lite Rwenzori Marathon.

Note on data management: We operate under the Principle of Least Privilege (PoLP), ensuring that team members only have access to the data necessary for their specific roles, minimizing exposure to sensitive information and reducing the risk of unauthorized sharing or misuse.
